How to Claim a Tax Refund from FBR

A tax refund arises when the tax withheld from you or paid in advance during the year exceeds your actual liability computed in the return. This is more common than many people realise. Salaried individuals whose employer over-withheld, business owners who suffered heavy withholding on receipts, and people who paid advance tax on property purchases often end the year with more tax paid than owed. Claiming that money back is a right, but it requires a deliberate process.

The first step is to make sure the return itself reflects the refund. In IRIS, every adjustable withholding you suffered must be entered in the tax paid section with the correct amount and, where possible, the CPR or certificate details. Withholding on salary, bank transactions, mobile phone bills, vehicle token tax, property purchases, electricity bills for commercial connections and contract receipts are all adjustable for most taxpayers. Omitting any of them means the refund is understated.

Once the return computes a refund, you must file a separate refund application. Filing the return alone does not trigger payment. In IRIS, the refund application is submitted under the Refunds menu for the relevant tax year, and it draws the refundable amount from the return already filed. The application asks you to confirm the bank account into which the refund should be paid, so ensure your IRIS profile has a current account number in your own name.

Supporting evidence is what determines the outcome. For salary withholding, keep the employer's annual salary certificate and the monthly payslips. For bank withholding, download the annual tax deduction certificate from your bank. For advance tax on property, keep the challan and the transfer documents. For withholding on contract payments, obtain the certificate from the payer. The FBR verifies claimed withholding against the withholding statements filed by the deducting agents, so the claim succeeds only where the agent actually deposited the tax and reported it under your CNIC.

Mismatches are the most common reason for delay. If your employer withheld tax but reported it late, incorrectly or not at all, your claim will be held until the record is corrected. Contact the withholding agent promptly and ask them to revise their statement. Similarly, if a bank reported withholding under an old CNIC format or a different name, the credit may not appear in your account. Resolving these issues before filing the application saves months.

Processing times vary. The law prescribes a period within which the Commissioner should decide, but in practice refunds for individuals can take anywhere from a few months to considerably longer, depending on the amount, the office and the quality of the documentation. Larger refunds are more likely to be subjected to verification, and the officer may issue a notice asking for documents or an explanation. Respond fully and within the deadline; an unanswered notice effectively stalls the claim.

You may also choose to adjust a refund against future liability instead of receiving cash. Where you expect to owe tax in the coming year, carrying the refund forward as a credit is administratively simpler and avoids waiting for payment. IRIS allows the refund of one year to be applied against the demand of another, and this is frequently the practical solution for businesses.

Refunds arising from final taxes cannot be claimed, because final tax settles the liability on that income regardless of your overall position. Withholding on dividends, profit on debt within the final tax regime, and export proceeds are examples. Only adjustable withholding and advance tax generate refunds, which is why correctly classifying each withholding in the return matters.

Persistence pays. Keep a file with the acknowledgement of the refund application, copies of every certificate and a note of each follow-up. If a claim remains undecided beyond a reasonable period, a written reminder to the Commissioner, and in appropriate cases an application to the Federal Tax Ombudsman, can move the process. Refunds are your money; a well-documented claim filed promptly gives you the best chance of seeing it returned.
