Filer vs Non-Filer: The Real Cost of Buying Property in Pakistan

Buying or selling property is the largest financial transaction most Pakistanis will ever make, and it is also where the difference between being a filer and a non-filer shows up most dramatically. Several layers of tax and duty attach to a property transfer, and the federal advance income taxes are charged at sharply different rates depending on whether the buyer and the seller appear on the Active Taxpayers List.

The buyer pays advance income tax under section 236K at the time of registration or transfer. This is calculated on the value of the property as determined by the FBR valuation table for the area, or the declared consideration if higher. The rate for filers has been a few percent in recent years, while the rate for non-filers is set at a multiple of the filer rate. Recent budgets have also introduced a third, still higher category for persons who have filed late or are otherwise not fully compliant. On a property valued at twenty million rupees, the gap between the filer and non-filer rate can easily run into more than a million rupees.

The seller pays advance tax under section 236C, again with filer and non-filer rates. For the seller this tax is generally adjustable against the capital gains tax payable on the sale, whereas for the buyer the 236K tax is adjustable against their overall income tax liability for the year. Adjustable means the amount is not lost; it is credited when you file your return. A non-filer cannot claim that credit because they do not file, so the higher tax becomes a permanent cost.

Beyond federal advance tax, provincial charges apply. Stamp duty, capital value tax where still levied, registration fee and, in many cities, a town or development authority transfer fee are payable by the buyer. These do not depend on filer status but do depend on the declared value, which is why the FBR valuation tables now set a floor below which value cannot be declared.

Capital gains tax on the sale is separate from the advance taxes and is paid when the seller files the return. The rate has depended on the holding period and the type of property, with longer holding periods historically attracting lower or zero rates, though recent Finance Acts have narrowed these concessions and introduced a flat rate for properties acquired after a specified date. As always, check the schedule applicable to the year of sale.

The Federal Excise Duty on the allotment or transfer of commercial property and the first transfer of residential plots, introduced in a recent budget, adds another charge in certain transactions. Developers and builders collect this at the time of booking or transfer. Buyers should ask for a breakdown of every charge in the demand letter so that they know which amounts are tax, which are fees and which are the developer's own charges.

Financing also feels the effect of filer status. Banks offering home finance require the applicant to be a filer, both because of internal policy and because non-filers face higher withholding on the banking transactions involved. A non-filer who wishes to take a mortgage will usually be told to file first.

Declaring the purchase in your wealth statement is mandatory. The property appears as an asset at cost, and the source of funds must be traceable to income, savings, loans or documented gifts. The FBR receives transfer data from registrars and housing authorities, and a purchase that does not appear in the buyer's wealth statement, or appears without an adequate source, is a frequent cause of notices.

The lesson is simple and expensive to ignore. If you intend to buy or sell property in the coming year, file your return now so that your name appears on the Active Taxpayers List before the transaction. The cost of engaging a tax adviser to file a return is a small fraction of the extra tax a non-filer pays on a single transfer, and the credit a filer receives for advance tax paid can be substantial when the annual return is filed.
